Netsertive Inc. (”Netsertive” or “we” or “us”) provides various advertising technology services and solutions (”Technology”), enabling media companies, advertising agencies and advertisers to deliver dynamic and interactive advertising campaigns via standard display ad units. This privacy policy (”Policy”) explains how personal information is collected, used and disclosed by Netsertive with respect to your use of the website located at http://www.netsertive.com (the “Site”) and how personal information is collected, used and processed through the Technology on behalf of the online advertisers, publishers, business partners, and other businesses that use our services (”Clients”). Netsertive adheres to the Digital Advertising Alliance’s Self-Regulatory Principles for Online Behavioral Advertising, http://www.aboutads.info, complies with the Network Advertising Initiative (“NAI”), and adheres to NAI’s code of conduct, https://www.networkadvertising.org/code-enforcement/code.

Privacy Policies for the Site

Personally Identifiable Information

Netsertive is the sole owner of the information collected on this site. We collect Personal Information that you submit to us voluntarily.  The Personal Information we collect includes, but is not limited to, the following: name, mailing address, Web address, telephone number, e-mail address, and information contained in any e-mail or other communication you send to us or information you give to us in any other way (collectively, “PII”). We do not sell or rent PII to anyone. Except as otherwise provided in this Privacy Policy, we strive to keep your Personal Information private and will not share it with third parties.

For example, you may choose to send us PII in an email or by completing an online form or submitting comments on the Site. PII may also be collected if you provide such information in connection with creating a profile, leaving comments, posting content, sending an email or message to another user, or participating in forums or features on the Site. Once collected, we may store your PII for a reasonable time for record keeping purposes. The information that we store is usually deleted as space requires or in the normal course of business. Netsertive may store and process PII in the United States and other countries.

In general, we use PII we collect to process your requests or transactions; to provide you with information, products or services you request; to inform you about other information, events, promotions, products or services we think will be of interest to you; to facilitate your use of, and our administration and operation of, the Site; for general purposes relating to the Site or Netsertive; and for the purpose for which the information was provided. Netsertive may use your email address to send you updates about new services, promotions, special offers, and other Netsertive communications. We reserve the right to send registration confirmation emails and service status messages to Clients. You cannot opt out of service status messages. An example of a service status message is notification of impending closure of an abandoned or out of use account. Netsertive offers you the ability to control the email communications we send to you. Netsertive will always give you a chance to unsubscribe and discontinue receiving Netsertive email communication. Clear directions for doing so will appear in any email message we send to you.

We may share PII and other personal information that you volunteer with our trusted Clients (which they may access via our Technology or an API).  In general, PII and any other information you submit or share with us through a Client advertisement may be used by that Client to customize the content and advertisements you receive from them; to communicate with you, including via email and social media; and to offer you additional information, opportunities, promotions and functionality related to the Client’s products and services.  Once your PII and other personal information is shared by us with a Client, the Client may store your PII and other information for a reasonable period of time and for record keeping purposes.

Non-Personally Identifiable Information


We may automatically collect certain information when you use the Site, such as your IP host address, pages viewed, browser type, Internet browsing and usage habits, Internet Service Provider, domain name, the time/date of your visit to the Site, the referring URL, your computer’s operating system, and other information (“Non-PII”). We treat Non-PII as PII if we combine it with or link it to any PII. Otherwise, it is used in the aggregate only. We use this information to understand our Site traffic and for improvement of and maintenance of the Site. Aggregate information (e.g., data we collect about use of the Site, or about a group or category of products, services or users, from which individual identities have been removed) helps us understand trends and our users’ needs so that we can better consider new features or otherwise tailor the Site. This Policy in no way restricts or limits our collection and use of aggregate information. We retain impression level Non-PII data for a period up to12 months (for advertising purposes) and may store aggregate Non-PII data for a longer period to improve the products and services we offer.

Cookies and Web Beacons

We may automatically collect certain information through the use of “cookies” and web beacons. Cookies are small text files that contain a string of alphanumeric characters and are stored on a user’s hard drive at the request of a Web site to enable the site to recognize users who have previously visited them and retain certain information such as customer preferences and history. If we link cookies to any PII, we will treat this information as PII. Web beacons (also known as “1X1 pixels” or “clear GIFs”) are small strings of code that provide a method for delivering a graphic image on a web page or in an email message for the purpose of transferring data.

We may also use third parties to serve ads on the Site or to help us track and analyze aggregate usage and statistical data from individuals who use the Site. These third parties may place cookies, web beacons, or other devices on your computer to collect Non-PII, and information provided by these devices may be used, among other things, to analyze data, to determine the popularity of certain content, to deliver advertising targeted to your interests and to better understand the usage and visitation of the Site and the other sites tracked by these third parties. This Policy does not apply to the use of third party cookies or web beacons.

If you wish to block, erase, or be warned of cookies, please refer to your browser manufacturer to learn about these functions. However, if a browser is set not to accept cookies or if a user rejects a cookie, some portions of the Site may not function properly.

Third Party Sites

The Site may contain links to other websites. Any personal information you provide on the linked pages is provided directly to that third party and is subject to that third party’s privacy policy. We are not responsible for the content or privacy and security practices and policies of websites to which we link. Links from the Site to third parties or to other websites are provided for your convenience. We encourage you to learn about their privacy, security practices, and policies before providing them with personal information.

Privacy Policies for the Technology

Overview of our Technology

Our Technology is used by Netsertive, Clients, and other third parties to serve advertising on websites of Clients and other third parties. You may encounter our Technology, for example, when we purchase online advertisements on a website that you visit; when one of our Clients purchases or sells online advertisements on a website that you visit; and/or when one of our Clients places one of our web beacons on its website, which you visit. We use the information collected by our Technology in order to help make the online ads you see more relevant to you, for ad delivery and reporting purposes, and for other purposes described in this Policy.

Personally Identifiable Information

We may collect certain information you voluntarily provide to us through the Technology which may contain PII. For example, some of the advertisements delivered using our Technology provide users the opportunity to request information from Clients, or in the case of our own Advertising Campaigns, from Netsertive. These request forms require users to provide contact information, including, but not limited to, your name, address, email address, phone number, and other comments. This information is used to send information about Clients or Netsertive to the user requesting that information. Once collected, we may store your PII for a reasonable time for record keeping purposes. The information that we store is usually deleted as space requires or in the normal course of business. Netsertive may store and process PII in the United States and other countries. You may choose NOT to provide this information via our Technology, but instead call the Clients or Netsertive and request to have the information sent to you.

We may share personal information that you volunteer with our trusted Clients (which they may access via our Technology or an API).  In general, personal information and other information you submit or share with us through a Client advertisement may be used by that Client to customize the content and advertisements you receive from them; to communicate with you, including via email and social media; and to offer you additional information, opportunities, promotions and/or functionality related to the Client’s products and services.  Once your PII is shared by us with a Client, the Client may store your PII for a reasonable period of time and for record keeping purposes.

Non-Personally Identifiable Information

We may automatically collect certain Non-PII through our Technology, including but not limited to your IP host address, pages viewed, browser type, the URL, the referring URL, the advertisement’s position on the website, video viewing metrics, Internet Service Provider, your computer’s operating system, and responses to surveys implemented via our Technology. We treat Non-PII as PII if we combine it with or link it to any of the PII mentioned above. Otherwise, it is used in the aggregate only. We use this information in order to help make the online ads you see more relevant to you, for ad delivery and reporting purposes, for measuring and tracking the success of Advertising Campaigns, and for other purposes described in this Policy. This Policy in no way restricts or limits our collection and use of aggregate information. We retain impression level Non-PII data for a period up to12 months (for advertising purposes) and may store aggregate Non-PII data for a longer period to improve the products and services we offer.

Cookies and Web beacons

Our Technology may automatically collect certain information through the use of cookies and web beacons. This information is used for conversion tracking and to measure the success of our online Advertising Campaigns, and the campaigns of our Clients. Specifically our use of cookies correlates whether you saw an ad Impression or chose to view a video ad from that Impression, with whether you later went to another page on our Site or on a Client’s website.

Controlling the use of your information

Opting out of Cookies

If you wish to opt-out of having Netsertive use your Non-PII collected through the Technology for conversion tracking, please email info@netsertive.com. When you opt out, we will place an opt-out cookie on your computer. The opt-out cookie tells us not to correlate whether you saw an ad Impression or chose to view a video ad from that Impression, or whether you later went to another page on a Client’s website. However, placing an opt-out cookie on your computer does not remove any cookies that were previously placed on your computer and those cookies will continue to function until they are explicitly removed. Please note that if you delete, block or otherwise restrict cookies, or if you use a different computer or Internet browser, you may need to renew your opt-out choice. Additionally, if you have viewed a page prior to opting-out, we will continue to retain the cookies that exist from that activity.

If you have set your browser to “block all cookies” and you click the “Opt Out” button on the opt out page sent to you by info@netsertive.com after requesting it, the message after you click the button will indicate “Opt out successful," even though an opt-out cookie was not placed in your browser (because you have set your browser to “block all cookies”). As of the date this Policy was last revised (set forth above), we are working to resolve this issue.

Information Security

Netsertive takes reasonable security measures to protect your PII in an effort to prevent loss, unauthorized access, destruction, misuse, modification and disclosure. We operate secure data networks protected by industry standard firewall and password protection systems and only Netsertive authorized personnel are granted access to the information provided by our Clients or users of the Site. Please be aware, however, that despite our efforts, no security measures are perfect or impenetrable. To help protect the confidentiality of your PII, you must keep your password confidential and not disclose it to any other person. You are responsible for all uses of the Site and/or the Technology by any person using your password. Please advise us immediately if you believe your password has been misused.

Unfortunately, the transmission of information over the Internet is not completely secure. Although we have implemented security measures that we think are adequate, we cannot guarantee the security of your Personal Information transmitted to our site. Any transmission of Personal Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Site.

Disclosure of information to third parties

We do not share PII we collect from you on the Site or through the Technology with non-affiliated third parties except as described in this Policy, as it may be revised from time to time. We may, however, share your PII with vendors, consultants, and other service providers (“Service Providers”) who are engaged by or working with us in connection with the operation of the Sites or the services we provide and who need access to such information to carry out their work for us. For example, Netsertive may use a third party to manage credit card processing. In some cases, the applicable Service Provider may be directly collecting the information from you on our behalf. We may also share personal information with other third parties when you give us your consent to do so. We are not responsible for the actions of Service Providers or other third parties, nor are we responsible for any additional information you provide directly to these Service Providers or other third parties, and we encourage you to become familiar with their practices before disclosing information directly to them. Nothing herein restricts the sharing of aggregate information, which may be shared with third parties without your consent.

We may share Non-PII we collect from you on the Site or through the Technology with Clients and other third parties. Similarly, we may enhance the Non-PII we collect from you on the Site or through the Technology with Non-PII collected from Clients.
We may disclose your personal information to third parties in the good faith belief that we are authorized or obligated to do so by law, or that doing so is reasonably necessary or appropriate to comply with the law or with legal process or authorities, to respond to any claims, to protect the rights, property or safety of Netsertive, its users, its employees or the public, or to investigate, prevent, or take action regarding suspected or actual prohibited activities, including but not limited to, fraud and situations involving potential threats to the physical safety of any person. If you send us a notification of claimed infringement under the Digital Millennium Copyright Act, any personal information in your notification may be shared with the person or entity who you claim is infringing your copyrighted material.

We may disclose and transfer any information, including without limitation PII and Non-PII, as part of, or during negotiations of, any merger, consolidation, sale of assets, bankruptcy, financing, or acquisition or in any other situation where personal information may be transferred as one of the business assets of Netsertive.

You understand that when you use the Site, information you post in your profile, blogs, bulletin boards, groups, forums and other community areas of the Sites (“Community Areas”), as well as any information you share with individuals through the Site, will be available to other users and in some cases may be publicly available. We recommend you be cautious about giving out personal information to others or sharing personal information in Community Areas, whether designated as public or private. We are not responsible for the personal information you choose to share in these Community Areas or for the actions of any third parties with whom you share personal information.

California Civil Code Section § 1798.83 permits users of our Site that are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. To make such a request, please send an e-mail to privacy@netsertive.com.

Children under the age of thirteen (13)

Our Site and Products are not intended for children under 13 years of age, and no one under age 13 may provide any information to this Site. We do not knowingly collect Personal Information from children under 13. If you are under 13, do not use or provide any information on this Site, make any purchases through this Site, use any of the interactive or public comment features of this Site or provide any information about yourself to us, including your name, address, telephone number, e-mail address or any screen name or user name you may use. If we learn we have collected or received Personal Information from a child under 13 without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under 13, please contact us at privacy@netsertive.com.

Users outside of the United States

Our Site is hosted in the United States and our Products are delivered from the United States. It is possible that certain information will be stored on servers in multiple other countries on the “cloud” or other similar distributed hosting platforms. If you are a user accessing our Site or Products from the European Union, Asia or any other region with laws governing personal data collection, use, and disclosure that differ from United States laws, please note that you are transferring your Personal Information outside your home jurisdiction, and that by providing your Personal Information you are consenting to the transfer of your Personal Information to the United States and other jurisdictions as indicated above, and to our use of your Personal Information in accordance with this policy.

Acceptance of Privacy Policy

By using the Site and our Products , you signify your assent to our Privacy Policy. If you do not agree with this Privacy Policy, please do not use our Site or Products. Your continued use of this Site and our Products following posting of changes to these terms will mean you accept those changes.

Changes to this Privacy Policy

We reserve the right to change the provisions of this Policy at any time. We will alert you that changes have been made by indicating on the Policy the date it was last updated. If we make any material changes to this Policy, we may post a clear and conspicuous notice of those changes on the Site and in this Policy. We encourage you to review this Policy from time to time to make sure that you understand how any personal information you provide will be used.

This Policy was last revised effective as of November 20, 2020.
